Terms & Conditions

The terms that apply to our towing, recovery and roadside services, and to your use of this website.

Two things worth reading before anything else: arrival times we quote are estimates rather than guarantees, and you should remove valuables from a vehicle before it is towed.

Who we are and what you are agreeing to

AT Towing LLC (“AT Towing LLC,” doing business as “AT Towing,” and referred to here as “we,” “us” or “our”) provides towing, vehicle recovery and roadside assistance in Benicia, Concord and the surrounding Bay Area.

These terms govern your use of our website at https://www.at-towing.com and the services we provide to you. By using this website, or by requesting or accepting service from us, you agree to these terms. If you do not agree, please do not use the site or request service.

Use of this website

The content on this site is provided for general information about our services. Descriptions of what we do, the areas we cover and typical response times are informational and do not by themselves create a contract or a guarantee.

The text, layout, design and photographs on this site are our property or used with permission, and are protected by copyright and other laws. You may view and print pages for your own use in arranging service. You may not copy, republish, scrape or use our content or photographs for commercial purposes without our written permission.

You agree not to interfere with the operation of the site, attempt to gain unauthorised access to it, or use automated tools to extract its content.

Services we provide

Depending on the situation and the equipment available, we provide light-, medium- and heavy-duty towing, accident and off-road recovery, flatbed transport, equipment hauling, jumpstarts, lockout assistance, tyre changes, emergency fuel delivery and winch-outs.

We decide, in our professional judgement, whether a particular job can be performed safely and with the equipment we have. We may decline or discontinue a job if conditions are unsafe, if the vehicle or site cannot be worked safely, if we cannot verify authority to move the vehicle, or if performing the work would risk damage we are not willing to accept.

Requesting service and authority to authorise a tow

When you request service, you confirm that you are the owner of the vehicle or are otherwise authorised to have it moved, serviced or entered. This matters most for lockouts and for tows arranged by someone other than the registered owner.

For lockout service we will ask you to show that you are entitled to enter the vehicle — registration, an insurance card, or identification matching the vehicle's records. We may decline service if you cannot.

You are responsible for the accuracy of what you tell us, including the vehicle type, its condition, whether it is loaded, and where it is. If the job on arrival is materially different from what was described, the price may change and we may not have the right equipment on scene.

Response times are estimates

Any arrival time we give you — on this website, over the phone, or by text — is a good-faith estimate, not a guarantee. Traffic, weather, road closures, bridge congestion, the availability of specific heavy equipment, and the queue of calls ahead of you all affect how quickly we arrive.

We are not liable for losses arising from a delay, including missed appointments, flights, connections or business interruption. If we cannot reach you in a reasonable time we will tell you so you can make other arrangements.

Rates, payment and deposits

Charges depend on the class of vehicle, the equipment and crew required, the distance travelled, the time of day, and the complexity of the recovery. Heavy-duty recovery, winching, extra labour, specialised rigging and standby time are billed in addition to the base tow.

We will quote you a price before work begins. Where the scope changes once we are on scene — a vehicle is loaded when we were told it was empty, or a recovery turns out to be materially harder than described — we will tell you the revised price before continuing.

Payment is due when the service is completed unless you hold an approved account with us. We may require a deposit for long-distance transport or for jobs requiring specialised equipment. Amounts left unpaid may accrue interest and reasonable collection costs to the extent permitted by law.

Where a tow is performed at the direction of a public agency or a private property owner rather than at your request, rates are governed by applicable law and by any published or filed rate schedule that applies.

Vehicle condition and personal property

We photograph vehicles before loading and after delivery to record their condition. We encourage you to be present at pickup and to note any pre-existing damage at that time.

Remove your valuables. We are not responsible for money, electronics, documents, tools, keys, cargo or other personal property left in or on a vehicle. If a vehicle is towed without you present, retrieve your property as soon as the vehicle is released to you.

You must tell us about anything that affects safe handling: aftermarket suspension, low ground clearance, a disabled drivetrain, a damaged frame, an electric or hybrid drivetrain, hazardous materials, or unsecured cargo. Some vehicles carry manufacturer transport requirements; tell us if yours does and we will follow them where we can. We are not liable for damage arising from a condition you knew about and did not disclose.

Storage, release and liens

Where a vehicle is placed into storage, storage fees accrue daily from the date of arrival until the vehicle is released, including the first day.

To collect a stored vehicle you must show proof of ownership or authority to take possession, valid identification, and pay all towing and storage charges owed. Vehicles are released during posted business hours.

Unclaimed vehicles are handled under California law, which gives a towing and storage operator a lien for its charges and, after the required notices and waiting periods, the right to sell the vehicle to satisfy that lien. The applicable provisions include the California Vehicle Code and Civil Code sections governing towing, storage and lien sales. Nothing in these terms enlarges or reduces the rights and notice requirements those statutes give you.

Cancellations and failed dispatch

Tell us as soon as possible if you no longer need a truck. If you cancel after a truck has been dispatched, or if we arrive and the vehicle is gone, is inaccessible, or nobody with authority is present, we may charge a call-out fee reflecting the trip.

If we arrive and cannot perform the job because the situation was described inaccurately, the same applies.

Your responsibilities and safety on scene

If you are broken down on a highway, stay in your vehicle with your seatbelt fastened, doors locked and hazard lights on, unless it is unsafe to remain. Do not stand between vehicles or on the traffic side of the shoulder.

On scene, please follow our operator's instructions, keep passengers, children and animals clear of the equipment, and do not attempt to assist with rigging, winching or loading. Working space around a wrecker is dangerous, and you agree not to enter the work area while equipment is in motion.

Passengers ride with us only where it is lawful and safe to carry them, at our discretion.

Limitation of liability

We carry the insurance required for the work we perform, and we take responsibility for damage caused by our own negligence in handling your vehicle.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost wages, loss of use, missed appointments or business interruption, arising out of our services or your use of this website. To the fullest extent permitted by law, our total liability for any claim relating to a job is limited to the amount you paid us for that job, except where the loss results from our gross negligence or wilful misconduct.

We are not liable for damage arising from pre-existing mechanical or structural conditions, from undisclosed vehicle modifications, from a recovery performed at your written direction against our advice, or from circumstances outside our reasonable control.

Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here affects rights you have under California consumer protection law.

Indemnification

You agree to indemnify and hold us harmless from claims, losses and reasonable costs arising from your breach of these terms, from your having directed us to move a vehicle you were not authorised to move, or from inaccurate information you gave us about a vehicle or a job.

Insurance, motor clubs and third-party billing

Where a job is billed to your insurer, motor club or employer, you remain responsible for any amount that party declines to pay. Coverage limits, deductibles and eligibility are matters between you and that party, and we cannot confirm what your policy or membership covers.

We will provide the documentation an insurer or claims adjuster reasonably needs to process a claim.

Discounts and promotions

We offer a discount to active-duty service members and veterans, and we run seasonal promotions from time to time. Mention the discount when you call — it cannot be applied after an invoice is settled. Proof of service may be requested. Discounts apply to our own labour and towing charges, not to third-party costs, storage lien charges, or tows performed at the direction of a public agency or property owner, and they may not be combined with other offers unless we say otherwise.

Chat feature and third-party links

The chat feature on this site is operated by a third-party provider. Messages you send through it are handled as described in our privacy policy. Do not send payment card numbers or other sensitive information through chat; call us instead.

Chat is monitored during business operations but is not a guaranteed emergency channel. If you are stranded, in traffic, or in any unsafe situation, call us rather than using chat. If there is a medical emergency, a fire, or an immediate danger to anyone, call 911 first.

This site may link to websites we do not control. We are not responsible for their content or their practices.

Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts serving Solano County, California, and you and we consent to the jurisdiction of those courts.

Please contact us first. Most disputes about a charge or a job are resolved faster by a phone call than by anything else.

If any provision of these terms is held unenforceable, the rest remain in effect.

Changes to these terms

We may update these terms from time to time. The current version is always posted on this page with its effective date. The terms that apply to a given job are the ones in effect when you requested that job.
